1. Overview
Welcome to BrightRoom. These Terms of Service (“Terms”) govern your access to and use of our website, platform, and related services (collectively, the “Service”). By using BrightRoom, you agree to these Terms. If you do not agree, please stop using the Service.
2. Who We Are
BrightRoom, Inc. (“BrightRoom,” “we,” “our,” “us”) is an educational technology company based in New York, USA. We help students write authentic essays and help educators personalize feedback using AI assistance.
3. Eligibility
You must be at least 13 years old to use BrightRoom. By using the Service, you confirm that you meet this requirement and have any necessary school or parental consent.
4. Use of the Service
- Use BrightRoom only for lawful educational purposes;
- Do not upload content that is illegal, abusive, or infringes others’ rights;
- Do not attempt to reverse engineer, disrupt, or misuse the platform;
- Maintain accurate account information and safeguard your login credentials.
We may suspend or terminate accounts that violate these Terms or pose security risks.
5. Intellectual Property
All BrightRoom content, trademarks, and software are owned by BrightRoom, Inc. You retain ownership of your essays, drafts, and teaching materials. By uploading or creating content, you grant BrightRoom a limited, revocable license to host, process, and display that content solely to operate the Service. Teachers’ uploaded materials are used only to support their own digital twin, not shared with others.
6. AI-Generated Feedback and Limitations
BrightRoom uses AI technology — including services provided by OpenAI — to offer writing suggestions and educator support. AI feedback is designed to enhance, not replace, human judgment.
- AI outputs may contain inaccuracies or biases;
- Final responsibility for submitted work lies with the student or educator; and
- BrightRoom is not liable for any academic, professional, or disciplinary outcomes arising from use of AI-generated feedback.
7. Account Management
You can close your account at any time. We may retain limited information as described in our Privacy Policy for compliance and support purposes.
8. Payment and Fees
At this time, BrightRoom may offer free and pilot access. If paid features become available, pricing and billing terms will be provided before purchase.
9. Third-Party Services
BrightRoom integrates with third-party systems like Google Classroom and relies on vendors such as Supabase, OpenAI, Railway, and Loops.so. We are not responsible for the availability, security, or practices of third-party services, and your use of them may be subject to their own terms.
10. Disclaimers
BrightRoom is provided “as is” without warranties of any kind. We do not guarantee uninterrupted operation or error-free output, including from AI components. To the fullest extent permitted by law, BrightRoom disclaims all implied warranties, including fitness for a particular purpose, accuracy, or non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, BrightRoom and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of data, academic impact, or reputation, arising from the use of the Service. Our total liability will not exceed the amount you paid (if any) for access during the six months prior to the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless BrightRoom, its officers, employees, and partners from any claim, loss, or expense arising from your use of the Service or violation of these Terms.
13. Termination
You or BrightRoom may terminate your account at any time. Upon termination, your right to use the Service ceases immediately, and your data will be handled according to our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes will be resolved in state or federal courts located in New York.
15. Changes to These Terms
We may modify these Terms at any time. Updates will be posted on our website, and continued use after changes means you accept the revised Terms.
